- The 100 holidays offer shall be valid even if only a minimum of 250 SMS are
received.
- Participation in the quiz is open to subscribers of Vodafone, Idea, BPL,
Reliance, Tata Indicom, Airtel, BSNL.
- All promotional materials, including details on how to enter and claim prizes
are part of these Terms and Conditions of Entry. The 100 holidays are funded
from a special promotional budget/fund created by Cox & Kings.
- The 100 holidays to Korea consist of 50 couple holiday packages (15 couple
Bumper and 35 couple Bonanza Holidays).
- The Bumper holiday package includes both airfare and land
arrangements.
- The Bonanza holiday packages include only accommodation
arrangements and no airfare.
The decision as to which of the holiday packages is given to the winner
participant remains with Cox & Kings.
- BUMPER HOLIDAYS:
There are 15 holiday packages for 15 couples. :
Bumper Couple Holidays to Seoul include: Economy return airfare, 4 star
hotel accommodation with breakfast, city tour of Seoul, return airport transfer
on seat in a coach basis.
The holiday excludes: Visa fees, overseas medical insurance, meals, hotel /
city / hotel transfers, optional excursions and all taxes and YQ taxes.
- BONANZA HOLIDAYS:
There are 35 holiday packages for 35 couples.
Bonanza Couple Holidays to Seoul include: 4 star hotel accommodation
with breakfast, return airport transfer on seat in a coach basis.
The holiday excludes: Airfare, meals, visa fees, overseas medical insurance,
hotel / city and hotel, optional excursions and all taxes and YQ taxes.
- All participants irrespective of the results of the SMS quiz are eligible for a
20% discount per person on an international tour to Korea (selected land
packages only ) or 10% discount per person on any Cox and Kings Duniya
Dekho or Flexihol or Bharat Deko (selected land packages only ). This will
be provided via a promo code that is sent to the participant's mobile. Please
note that discounts are on selected land packages only and not on other
services such as airfares, visas, insurance, optional tours cost etc.
The following items are not included in your free holiday
- Airport taxes, service tax, govt. sales tax and all other govt. taxes.
- Optional / Add-On tours unless mentioned otherwise
- Cost of US$ 10,000 granted by the Reserve Bank of India under the
Basic Travel Quota Scheme.
- Sightseeing other than & what is mentioned in the itinerary.
- Airfare unless otherwise specifically mentioned.
- Any taxes and any increase in the airfare/ taxes / routing charged by
the airlines on air ticket ( presently calculated on August 30, 2009)
- Airline surcharge during high season levied by the operating airline
used in the itinerary.
- Cost of extension of validity of the air ticket.
- Any increase in the rate of USD (presently calculated at USD 1= INR
50) leading to an increase in Tour Cost coming into effect prior to
departure. The rate on the given day of payment will however apply.
- Any surcharges on the USD component owing to High Season, Trade
Fairs, Exhibitions, Conventions, Special Events, festivals etc.
- Porterage at hotels, apartments, airports and seaports, tips, laundry,
wines, mineral water, telephone charges, insurance and all items of
personal nature, also food and drinks.
- Visa charges.
- Overseas Medical Insurances charges.
- Passport charges and renewal of passports.
- Hotel / city / hotel transfers
- Meals unless specifically mentioned.
- Tips or any gratuities.
- Anything not specifically mentioned in 'What Your Tour Price
includes' box.
- The winners would have 3 weeks time within which they claim their prize
from the time they have been informed by the Company. After claiming
their prize, the winners would have a period of 1 month to accept their date
of travel. If the winners do not claim their prize or choose the date of their
travel within the prescribed time with their written or by email acceptance of
the same and by paying the taxes, visas, insurance, then their title to the
holiday would stand forfeited.
- The winners would be asked to furnish necessary documents, passports or
any other document, which Cox & Kings or their representatives may decide
in their sole discretion. After verification of the credentials, and on receipt
of all relevant documentation as mandated by Cox & Kings, the holidays
will be disbursed by Cox & Kings. The decision of Cox & Kings shall be
final and binding in this regard.
- A person should have completed 18 years of age, must be an Indian national
and must possess a valid passport for at least six months prior to the date of
departure to be eligible to participate in 100 holidays offer. If any holidays
are distributed to the winner under 18 years of age, the same shall stand
cancelled and forfeited and no claim thereof shall be entertained.
- The prize winner shall execute all such documentation as deemed necessary
by Cox & Kings to allow Cox & Kings and their assigns to use, display,
copy, modify, distribute, publish, sell, assign, exchange, license, sub-license,
in any and all locations, in any medium, form or format, in any number, the
picture, image or likeness and the reproductions of the winner, and any
biographical information furnished by the winner to Cox & Kings. The
company reserves the right to publish photographs / letters / web pictures
/videos / emails taken by the traveller during the holiday.
- The database of mobile numbers can be used in future for any lawful
purpose deemed fit by the Company.
- All prizes will be subject to Indian laws, including tax regulation as and
when applicable. Any statutory taxes or levies including Sales Tax, Service
Tax, Income Tax. TDS and all tax liabilities if applicable on any prize, will
have to be borne by the winner. Processing Charges, Visa Expenses,
Overseas Medical Insurance charges Airline and Airport (where applicable)
and other taxes, Passenger Service Charges, and other surcharges levied by
the airline and/or suppliers and any other taxes/charges, as applicable, are
payable by the winners.
- The Company will try to maintain the privacy of information provided by
the traveler. However, such information may have to be shared with hotels,
airlines and service providers. The information may be disclosed if the
Company receives an order of the court, a requisition from any government
or statutory authority, subpoena, or under any law, rules or regulations, such
disclosure becomes necessary.
- The winners or their legal heirs and representatives shall have no rights,
claims whatsoever against Cox & Kings.
- In case of any dispute or difference in respect of or in connection with the
Offer and/or the holidays therein, the decision of Cox & Kings shall be final

and binding on all concerned and no correspondence or appeals will be
entertained in this regard.
- By participating in the 100 holidays offer, each participant voluntarily
agrees to the terms set forth within the stated rules and regulations. All the
participants are deemed to have read the rules and regulations before joining
the 100 holidays offer.
- The participant is responsible for restricting access to his/her mobile phone,
and agrees to accept responsibility for all activities that occur from his/her
mobile phone.
- The participant agrees and undertakes to provide true, accurate, current and
complete information about himself / herself as and when requested by Cox
& Kings (such information being the "Registration Data"). If any
information provided is untrue, inaccurate, not current or incomplete or Cox
& Kings has reasonable grounds to suspect that such information is untrue,
inaccurate, not current or incomplete, or not in accordance with the Terms
and Conditions, Cox & Kings has the right to immediately forfeit the
holiday.
- If the participant's electronic communication does not reach the company or
vice versa for reasons including but not limited to any technical
malfunction, system service errors, network connectivity of the telecom
company or the facilitating company between the telecom operator and Cox
and Kings (I) Ltd. or incorrect input of the participants response or not
adhering to the correct format of managing or non availability of funds in
the participants account or any other reason which is beyond the control of
the company, then the company shall not be responsible for the
consequences of such omission or error and the participants cannot claim
compensation or a holiday or any other benefit in cash or kind in lieu
thereof.
- If the Company is unable to contact the participant due to the participant's
mobile being switched off / not reachable / out of service or any other
reason, the Company shall not be responsible for making further efforts to
contact the participant and the holiday would be forfeited and no benefit
given in lieu thereof .
- When the participant uses the Service, sends SMS messages or calls us or
uses the Website, the participant is communicating with us electronically
and consents to receive communications from us electronically.
- The participant agrees that all agreements, notices, disclosures and other
communications that we provide to the participant electronically satisfy any
legal requirement that such communications be in writing.
- Only the winners will be kept informed by CNK posting his/her name on
the website and by SMS. The Company shall be within its rights to send the
winner communications by SMS.
Upon dispatch of such communications, it shall be deemed that the winner
has the knowledge of the contents of such communication. The Company
shall not be liable for improper service/ delay by service providers and the
incidental consequences thereof if the winner fails to contact the Company
within 21 days of such communication being posted on the website, the
holiday shall be forfeited.
- Employees of Cox and Kings (India) Ltd, CORNERSHOP
ENTERTAINMENT COMPANY PRIVATE LIMITED, Saatchi & Saatchi,
Media Edge CIA and the telecom operators and their immediate family
members and relatives shall not be eligible to participate in this quiz.
- In case of any dispute or difference in respect of the quiz, Company's
decision shall be final and binding on all concerned.
- All disputes and matters arising under this '100 holidays offer' to Korea
campaign will be governed by Indian law and subject to the exclusive
jurisdiction of the courts and tribunals only in Mumbai.
- The company reserves the right to discontinue the promotion due to a 'force
majeure' or even without assigning reasons.
